At the Police Court to-day, the case against August Badke, adjourned from yesterday, for assaulting his father, David Badke, was proceeded with. The prosecutor stated in evidence that defendant lived on the same farm, with him; on the 9th October, ofter returning home from the One-eye Waterhole, two friends told him that some of his fence had been removed; went to a spot where between three and four chains of palings had been taken away ; prosecutor, his wife, and the two friends went there for the purpose of putting up the fence, but the defendant came with his trolly to remove it ; prosecutor's wife said, "Your are taking our palings;" and defendant then picked one up and struck her on the head ; he continued to beat her, and prosecutor cried, "Don't beat her; dont kill her ;" defendant then threw a paling at prosecutor, saying " I'll kill you, too ;" the paling struck him on the hand and knocked some of the skin off. Charles and Anna Wagner gave corroborative testimony, and Emil Badke and William Maddox were examined for the defence. The bench fined defendant 10s, and ordered him to pay £3 10s 6d costs. August Badke was also charged with having on the same occasion assaulted his mother, Wilhelmina Badke, causing her actual bodily harm. The evidence taken was similar to that given in the previous case. Dr. Webb, after describing the injuries the prosecutrix had sustained through the beating with the paling, stated that she was still in a very nervous condition and suffered much from the hurt to the left eye, but the other wounds were progressing favourably. The accused was committed to take his trial at the sittings of the District Court, to be holden at Ipswich on the 8th December next. Bail was allowed the accused in £80, and a surety to a similar amount.

August Badke surrendered to his bail on a charge of having, at Dugandan, on the 9th October last, unlawfully and maliciously wounded one Wilhelmina Badke (his mother). Mr. Power, instructed by Mr. Cardew, appeared for the accused, and pleaded guilty of a common assault, The Crown Prosecutor accepted the plea, and Mr. Power asked that only a fine should be inflicted, the affair being only a family squabble. His Honour, after perusing the depositions taken at the Police Court, fined the accused £5, intimating that he hoped this case would be a caution to him as to his future conduct.
