Layh v. Layh.
Petitioner, Alice Maude Mary Layh, who was represented by Mr. S. J. Mitchell, applied for the dissolution of her marriage with Christopher Friedrick Layh, on the grounds of misconduct. Respondent did not appear.
Petitioner gave evidence to the effect that she was married to respondent in April, 1886, at Kensington. They subsequently lived together at Gouger-street, and later she went to live with her parents at Norwood, as her husband had left her and gone to Melbourne. She followed him there in January, 1897, where she lived with him for a few weeks, after which she kept house for her brother. There had been no quarrel between them, but her husband had not supplied her with any means. He had also sold her furniture in Melbourne and with the proceeds went to Sydney. She left for Adelaide in November, 1898, after which her child, Laurence Christopher, was born. In 1899 her husband returned to Adelaide and she lived with him until December of the same year. He compelled her to work for her living and to maintain the child, although he had employment himself. At the end of the year he deserted her and had since been living with another woman at Norwood.
Further evidence was called.
His Honor said he found the allegations proved and would report to that effect to the Full Court.
